Terms & Conditions

 These Terms & Conditions outline the rules and regulations for the use of our transportation services. By booking a ride with us, you agree to comply with and be bound by these terms.


1. Scope of Services

These Terms & Conditions apply to the transportation of passengers over irregular routes on an irregular schedule.


1.1 Service Area

We provide transportation services between points in:

  • Roanoke County
  • Montgomery County
  • Pulaski County
  • Wythe County
  • Smyth County
  • Washington County
  • Albemarle County
  • Augusta County
  • Botetourt County
  • Goochland County
  • Hanover County
  • Henrico County
  • James City
  • Louisa County
  • New Kent County
  • Rockbridge County
  • Fluvanna County

The following cities that do not belong to counties:

  • Roanoke
  • Radford
  • Salem
  • Buena Vista
  • Charlottesville
  • Hampton
  • Lexington
  • Newport News
  • Norfolk
  • Richmond
  • Staunton
  • Virginia Beach
  • Waynesboro
  • Williamsburg
  • Bristol


1.2 Vehicle Capacity

Our services are restricted to passengers only, including the driver. Vehicles have a seating capacity of no more than 15.


2. Pricing and Charges


2.1 Service Charges

Specific rates for transportation services are provided at the time of booking and are dependent on the route, service type, and other factors.


2.2 Discounts and Promotions

We reserve the right to offer discounts or promotional rates. These may be offered through coupons, promotional codes, or other marketing initiatives. Discounts will be offered to all eligible customers under the same terms and conditions.


2.3 Other Charges

In addition to the base service charge, the following may apply:

  • Cleaning Charge: If, in our reasonable opinion, any passenger soils the vehicle to an unpresentable condition for further use, a cleaning charge may be assessed against that passenger or passengers.
  • Damage Charge: Vehicles are carefully inspected prior to each trip. Any damage to seats, windows, or other equipment or parts of the vehicle caused by a passenger or passengers shall be the responsibility of that passenger or passengers, and the costs for the repairs of such damages shall be paid by the passenger(s).
  • Tolls, Fees, and Special Charges: Our service charges do not include bridge, ferry, tunnel, or highway tolls, entrance fees, or charges for special licenses or permits. An additional charge will be assessed for the actual cost of such tolls, fees, or special charges.


3. Payment and Reservations

All charges for our transportation services are payable through our online payment system, accessible via desktop computer, tablet, smartphone, or other internet-enabled device. Payments may be made in advance through our website or at the point of service using the same online payment system.

Accepted payment methods include credit card, Apple Pay, Google Pay, PayPal, or other methods accepted by the online payment system.

Upon completion of payment, customers will receive a digital confirmation of their purchase, which serves as their proof of purchase. At the point of service, customers must present their digital confirmation or a valid government-issued photo identification (e.g., driver's license, passport, or state-issued ID) to verify their reservation. If a customer fails to provide valid proof of purchase or identification, we reserve the right to refuse service without refund.


4. Cancellations and Refunds


4.1 Cancellation Policy

  • Individual Ticket Purchases: Refunds will be issued for cancellations made at least forty-eight (48) hours prior to the scheduled departure time.
  • Group Bookings (four (4) or more passengers): Refunds will be issued for cancellations made at least five (5) business days prior to the scheduled travel date.

All refund requests must be submitted through our designated online portal or via written notice to info@pointofdeparture.us. Refunds will be processed to the original payment method.


4.2 Extenuating Circumstances

At our sole discretion, refunds may be considered in extenuating circumstances, including but not limited to documented hospitalization, death of the ticket holder or immediate family member, or force majeure events that prevent travel. We reserve the right to request and verify supporting documentation for such extenuating circumstances.


4.3 No Refunds

No refunds will be issued for cancellations made within the aforementioned timeframes, or for no-shows. We shall not be liable for any consequential losses or damages arising from cancellations.


5. Rules and Regulations


5.1 Baggage

  • Baggage will not be checked.
  • Personal baggage, musical instruments, athletic equipment, and other paraphernalia, limited to the capacity of the vehicle, will be transported in the custody of the passenger at no additional charge.
  • Liability for loss or damage of baggage will be limited to fifty dollars ($50.00) for each passenger if such loss is due to our fault or negligence.


5.2 Objectionable Persons

We reserve the right to refuse to transport a person or persons under the influence of intoxicating liquor or drugs, or who is incapable of taking care of themselves, or whose conduct is such, or is likely to be such, as to make them objectionable to other passengers. This rule does not apply to persons who are ill and are accompanied by an attendant or nurse.


5.3 Minors

It is expressly understood and agreed that the Carrier, in providing transportation services to any passenger under the age of eighteen (18) years who is not accompanied by a parent or legal guardian, does not assume any legal or equitable responsibility for the supervision, care, custody, or control of said minor. Our obligations are limited solely to the provision of transportation services as specified in the applicable contract. We shall not be held liable for any acts, omissions, or occurrences related to the minor's safety, well-being, or conduct, whether arising before, during, or after the provision of such transportation services.


5.4 Animals

We prohibit the transport of all animals, with the sole exception of service animals as defined by the Americans with Disabilities Act (ADA), which are required to accompany a passenger with a disability. Emotional support animals, comfort animals, and therapy animals are not considered service animals under the ADA and are therefore prohibited.


6. Limitation of Liability and Force Majeure

We shall not be liable for delays caused by Acts of God, public enemies, authority of law, quarantine, perils of navigation, riots, strikes, the hazards or dangers incident to a state of war, accidents, breakdowns, bad conditions of the road, snow storms, and other conditions beyond our control, including but not limited to force majeure events. We do not guarantee to arrive at or depart from any point at a specified time.

We will make reasonable efforts to maintain the schedule submitted by our agents or employees, but it is not guaranteed. Furthermore, we shall not be liable for any costs or losses incurred due to missed connections, appointments, or other consequential damages arising from such delays.

If any of the aforementioned conditions make it, in our opinion, inadvisable to operate equipment, either from the place of origin or any point en route, we shall not be liable therefor, or caused to be held liable for damages for any reason whatsoever.


7. Indemnification

You agree to indemnify, defend, and hold harmless Point of Departure, LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your use of our services, your violation of these Terms & Conditions, or your violation of any rights of another party, including but not limited to any claims related to personal injury, property damage, or violation of laws.


8. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis. Point of Departure, LLC makes no representations or warranties of any kind, express or implied, as to the operation of its services or the information, content, or materials included therein. To the fullest extent permissible by applicable law, Point of Departure, LLC disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Point of Departure, LLC does not warrant that its services will be uninterrupted, timely, secure, or error-free.


9. Governing Law and Dispute Resolution


9.1 Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.


9.2 Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms & Conditions or the breach, termination, or validity thereof shall be resolved exclusively through binding arbitration administered by a mutually agreed-upon arbitration service (e.g., American Arbitration Association) in Roanoke, Virginia, in accordance with its commercial arbitration rules. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The prevailing party in any arbitration or legal proceeding shall be entitled to recover its reasonable attorneys' fees and costs.


10. Severability

If any provision of these Terms & Conditions is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms & Conditions and shall not affect the validity and enforceability of any remaining provisions.


11. Entire Agreement

These Terms & Conditions constitute the entire agreement between you and Point of Departure, LLC regarding the use of our services and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and Point of Departure, LLC with respect to such services.


12. Changes to Terms & Conditions

Point of Departure, LLC reserves the right to modify or revise these Terms & Conditions at any time. We will provide notice of any changes by posting the updated Terms & Conditions on our website and updating the "Last Updated" date. Your continued use of our services after such modifications will constitute your acknowledgment and acceptance of the modified Terms & Conditions.


13. Definitions

  • Carrier: Throughout this document, Point of Departure, LLC will be referred to as "Carrier" or "We/Us."
